Waukesha (Wis.) district sued by parent after student contracts Covid

The parent contends that her child contracted Covid after being exposed by a classmate; the school district does not have a mask requirement in place.

The Waukesha (Wis.) school district is being sued by the parent of a student who has contracted Covid-19. 

The parent contends that her child, who attends Rose Glen Elementary, contracted Covid after being exposed to the disease by a classmate; at the time, the district did not have a mask requirement in place, reports WTMJ-TV.

The Waukesha district announced at the beginning of the 2020-21 school year that "[g]oing forward, the District will follow a mask optional approach to Covid-19."

The lawsuit asserts that a student  with Covid symptoms came to school on Sept. 16 and 17 before being sent home. The child whose parent is suing sat next to the symptomatic classmate each day, the suit says. On Sept. 19,  that child became symptomatic and tested positive for Covid. The parent said in the suit that her other children, also enrolled in the Waukesha district, became sick with Covid a few days later.

The Minocqua Brewing Company Super Pac, which is underwriting the cost of the lawsuit, hopes the legal action will result in a statewide mask requirement for schools.

School officials said in a statement: "We received a Covid complaint for filing yesterday. We have not been formally served. Immediately we contacted our attorneys and on the advice of our counsel we have been advised not to respond further at this time."
