Insurance company balks at claims involving child abuse at Los Angeles elementary school

Company sues to avoid paying settlement claims to students allegedly abused by a teacher at Miramonte Elementary.

An insurance company has sued the Los Angeles Unified School District seeking to avoid paying settlement costs related to child abuse at Miramonte Elementary School. The suit was brought by Everest National Insurance Co. The Los Angeles Times reports that if the suit is successful, the school system could be on the hook for an estimated $30 million that it has agreed to pay to 58 alleged victims of former teacher Mark Berndt. At least as many claims remain unresolved from victims seeking higher compensation than the settlement provides. Other insurers also have refused to pay Miramonte-related claims.
