Court dismissed breach-of-contract suit brought by former Capistrano (Calif.) superintendent

An Orange County judge has dismissed a $1.6 million breach-of-contract lawsuit filed by former Capistrano Unified schools chief James Fleming. The Orange County Register reports that the court decided that Fleming was four years too late in filing his claim. In the suit, Fleming contended that the district owed him money for back pay, legal bills and damages. Fleming retired in August 2006 but did not file his suit until June 2011. After his retirement, Fleming was criminally charged with ordering his staff to generate what prosecutors called "enemies" lists with the names of dozens of parent critics of his administration. A state appeals court ordered all of the charges dropped in December 2010.
