Capistrano board won't pay ex-superintendent's legal fees

Former administrator faces charges of misappropriating public funds.

The Capistrano (Calif.) Unified School District board has reaffirmed its decision not to pay the legal fees of former Supt. James Fleming, who has been indicted for allegedly creating enemies lists to thwart a recall. It was the third time this year that the board addressed the issue. During an Orange County Grand Jury investigation of district controversies in September, the board voted to pay Fleming's fees but rescinded the decision in March.

EARLIER: An indictment accuses the former superintendent of the Capistrano (Calif.) Unified District of using public funds to meddle in an election and create enemies lists. James A. Fleming has been charged with felony counts of misappropriating public funds, using district funds to influence an election and conspiracy to commit an act injurious to the public. The indictment also charges former Assistant Supt. Susan McGill with perjury and conspiracy to commit an act injurious to the public. (Los Angeles Times)

The man selected to become superintendent of the troubled Capistrano (Calif.) Unified School District has backed out of the deal. Dennis M. Smith, who had been expected to assume his duties July 1, has reconsidered taking the position because of "uncertainty and instability" facing the district. Smith was named in March to replace longtime Supt. James A. Fleming, who resigned in August after a 15-year tenure marred by controversies. Fleming was indicted last week on felony charges of misappropriating public funds. (Los Angeles Times)
