Court upholds school's decision to ban nuts

Parent sued after Romeo (Mich.) district prohibited nuts at Hevel Elementary

The Michigan Court of Appeals has upheld a Romeo school district decision to prohibit nuts from an elementary building. The Romeo Observer says the ruling upholds the dismissal of a lawsuit brought by a parent who objected to the nut ban at Hevel Elementary School. The district imposed the ban to protect the health of a student that has a "severe, life-threatening allergy" aggravated by airborne exposure to nuts. It tried having nut-free zones or peanut-free tables in the cafeteria, but this wasn't enough to prevent the child from being exposed.
